Read this document (the “Release of Liability”) carefully. This release agreement will affect your legal rights and will limit or eliminate your ability to bring a future lawsuit.
I, the Buyer, understand and appreciate that Central Florida Cycle Parts LLC (“Seller”) sells used vehicle parts and used tires, that unless otherwise specified these parts and tires are not in new nor re-manufactured condition when purchased from Central Florida Cycle Parts, LLC, that these serviced, reconditioned and/or rebuilt parts are used and sold AS-IS, and that a 30 day warranty, is given for the parts or any services provided by the seller, if found to be defective. A replacement will be provided, if no replacement can be provided the seller will be liable only for the purchase price of the part.
I, the Buyer, do hereby agree that Central Florida Cycle Parts, LLC has no control over the installation and use of the parts once sold. I also understand that Central Florida Cycle Parts, LLC highly recommends that certified professionals install all parts that it sells. I, the Buyer, agree that I rely on my own skill and judgment in evaluating the installation of parts bought from Central Florida Cycle Parts LLC, and I agree that I am solely responsible for the part’s use.
I, the Buyer, agree to hold the Seller (Central Florida Cycle Parts LLC) harmless from, and hereby assume the entire responsibility and liability for, any and all damage or injury of any kind or nature whatever, including death, as to all persons, whether Buyer's employees, agents or otherwise, and as to all property, including Buyer's own property, caused by, resulting from, arising out of, or occurring in connection with the use by Buyer or any other person, of any parts serviced by and or purchased from Central Florida Cycle Parts LLC.
I, the Buyer, agree that if any person makes a claim for any damage or injury, including death, resulting from the use of the parts or services Buyer purchased from Seller, whether based upon Seller's alleged active or passive negligence, or based upon principles of product liability, or based upon any alleged breach of any statutory/contractual or common law duty or obligation Seller may have, I shall defend, indemnify and hold harmless Seller, its agents, servants and employees, from and against any and all loss, expense, damage or injury that Seller may sustain as a result of any such claim.
I, the Buyer, agree that this agreement shall be governed by the law of the state of Florida and that in the event of a dispute between Buyer and Seller that exclusive jurisdiction and venue of such dispute resides in the courts of the State of Florida to the exclusion of all other jurisdictions.
Having read this agreement and knowing these facts and in consideration of Seller accepting my purchase, I, the Buyer, for myself and anyone entitled to act on my behalf, waive and release Central Florida Cycle Parts LLC, its members, shareholders, officers, directors, agents, volunteers and employees, from all claims or liabilities of any kind arising out of the installation and or use of parts sold and or serviced by Central Florida Cycle Parts LLC even though that liability may arise out of negligence or carelessness on the part of the Seller. VW Polo WRC makes the case for the 4WD VW Polo R We speculated a year ago that the Polo GTI wouldn’t be the top of the Polo tree, and that Volkswagon would roll out the VW Polo R in 2012, but perhaps with FWD instead of the 4WD its big brother, the Golf R, enjoys. But just a few months later it seemed clear that we would end up getting a 4WD Polo R at some point after Audi lost its bottle at the last minute and pulled the Audi S1 badge off a FWD A1, instead calling it the Audi A1 1.4 TFSI. That change of heart by Audi – saving the S1 badge for a quattro S1 – meant that a quattro platform would be developed for the S1, and as the A1 uses the Polo platform it meant a 4WD platform would be available for the Polo too.

New BMW 2 Series tease begins BMW’s plans to extend their model range continues, with the new BMW 2 Series due to join its larger sibling – the BMW 4 Series – as the 1 Class Coupe/Cabriolet. The official reveal for the new BMW 2 Series is expected at the end of next week, but ahead of that BMW has started to tease its new Coupe on video (below). We don’t get to see much – and what we do see isn’t a huge surprise – but we already know much of what to expect when the 2 Series starts to hit the road in 2014.
