By bidding on this
item, you agree to the Terms and
Conditions listed in this document.
Please ONLY BID after you have read,
understood and agree to these terms.
Assumptions
can be costly. A disappointed
Purchaser will have no recourse against
the State of Oregon, its Officers,
Agents or Employees for financial losses
attributed to the Purchaser's failure to
follow Oregon's General Sale Terms and
Conditions. |
Bidders are urged to inspect the
property prior to submitting a bid.
Bidders may inspect property at the
place and time specified in the
invitation to bid.
Unless otherwise specified in the
auction listing, payment in full must be
received within seven
from the close date of the auction.
Sales of items not paid in full within
the specified period will be cancelled.

Office

Monday-Friday (excluding holidays and
Furloughs). |
Unless otherwise specified in the
auction listing, the buyer must remove
purchased items from the sale site
within seven calendar days from the
close date of the auction. A buyer who
fails to remove property within the
specified period forfeits all rights to
the property as described in section
4(B) below.
Please Note:
Oregon’s Surplus Property Program will
help load a buyer’s property within
reasonable limits.
A. Auction Default:
Buyers who do not comply with Section 2
are barred from participating in online
auctions by the Oregon Surplus Property
Program until they submit a
reinstatement fee as follows: |

$25 per
occurrence (per each unpaid item) for
personal property items |
• |
$200 per
occurrence for vehicles or heavy
equipment |
B.
Removal Default:
Property paid for, but not claimed
within the specified period, is
considered abandoned. All right, title,
interest and ownership defaults to the
Oregon Surplus Property Program and the
buyer forfeits any payment made on the
property.
Please Note:
Any buyer who defaults, as provided in
this section, at two more auctions may
be permanently barred from participation
in future auctions at the sole
discretion of the Oregon Surplus
Property Program.
All property offered by Oregon’s Surplus
Property Program is sold “AS IS, WHERE
IS” with no warranty or other guarantee
as to its condition or fitness for any
use or purpose. Personal property or
vehicles listed as “non-op” or “working
condition unknown” should be considered
inoperable and in need of major repair.
The absence of “non-op” or “working
condition unknown” does not imply that
an item or vehicle works or functions
and will in no way constitute a basis
for a refund.
As may be provided in the auction
listing, the Oregon Surplus Property
Program may warrant certain items as to
the accuracy of their descriptions in
the listing. In such case, the Program
Manager may, in his or her sole
discretion, cancel the transaction or
offer a full or partial refund for
substantial deficiencies in the item’s
description.Except as stated in this
section, the Oregon Surplus Property
Program will not accept property for
return or adjustment. Refunds or
adjustments will not exceed the purchase
(bid) price. The Oregon Surplus Property
Program offers no compensation for
shipping costs, travel expenses or
effort.
The Oregon Surplus Property Program
reserves the right to withdraw any
property from auction prior to sale or
to reject any and all bids regarded as
not in the best interests of the State.
Buyers or disappointed bidders have no
recourse against the State of Oregon or
any of its employees or agents.

Property Removal

Removal of Property
is required within 7 days of the
auction's close. |

Purchasers shall be
permitted to remove property from
Oregon's Property Distribution Center (PDC)
in Salem during weekdays, excluding
holidays, from 1- 4pm unless you receive
prior written authorization from The
Property Custodian. Items WILL NOT BE
RELEASED from the Salem PDC before 1pm
or after 4pm (weekdays, excluding
holidays) without prior written
approval. |

Should the Purchaser
elect to have another person or entity
pick up the property, a letter of
authorization must be furnished to the
satisfaction of the Property Custodian
before any item is released from
Oregon's Property Distribution Center. |
• |
All industrial type
equipment used by successful bidders on
Government property to load, unload,
tow, repair, modify, etc., must meet
Occupational, Safety, and Health
Administration Standards. |
• |
Oregon’s Surplus
Staff may bring purchaser's property to
our customer loading area which may
include forklift assistance. We reserve
the right to refuse loading assistance
of any kind with no explanation. It is
the purchaser's responsibility to secure
their item – we will not provide any
assistance, supplies or equipment for
securing items. |

company we are referring our customers

Provide us a
completed copy of your shipper’s Bill of
Lading which must include the Customer
Name and eBay Number(s), so that we may
identify your shipment when your shipper
arrives. This can be faxed to
503-378-3398. |

If your shipper does
not use Bills of Lading, you will need
to provide to us a letter of
authorization, giving permission for us
to release your item(s) and it must
include the Customer Name and eBay
Number(s). This can be faxed to
503-378-3398. |
We need
to receive 3 business days notice prior
to the shipment date.
Failure to comply may result in sending
your shipper away empty handed, extra
costs to you for "Freight Not Tendered",
and a delay in your shipment. |
Regardless how your
item is shipped, it is important that
when your item arrives, that you unwrap
your shipment while the driver is there,
or before you leave the freight
terminal, and inspect for damage.
Failure to do this will result in your
inability to file a successful damage
claim on damaged merchandise! If damage
is found, please note on paperwork
(Freight receipt) as to what is damaged,
so that both you and the shipping
company have records. |
